Ensuring effectiveness and the rule of law in a shared legal order
This theme centres on the rule of law. It will take stock of the requirements and challenges that the developments in EU enforcement entail for the rule of law. A conference will be held at the University of Zurich to discuss how this fundamental tenet of EU constitutional law could be rethought to legitimate, guide, and curb the enforcement of its laws. A complementary research project will address the complex relationship between the rule of law and effectiveness. It will identify and analyse their antagonistic as well as symbiotic connections and, hence, challenge the orthodox view that sees both principles in permanent tension. Both prongs contribute to EULEN’s mission of defining common constitutional benchmarks for the enforcement of EU law.
At the end of 2020, the University of Bonn will host a meeting of the coordinators and a sectoral roundtable. A selected number of policy makers will be invited as speakers to debate the pertinent issues on enforcement in the different sectors (EU competition law, EU banking and financial services, fight against EU financial fraud, and EU migration, border management and asylum) with selected academic experts and young researchers presenting their research findings.
